I HEREBY ASSUME THE RISKS OF PARTICIPATING IN ALL CLEVELAND TRIATHLON CLUB EVENTS, including but not limited to, training, racing, clinics, functions, activities and any other events associated with the Cleveland Triathlon Club (collectively "club events").  I certify that I am physically fit, have sufficiently trained for participation in Cleveland Triathlon Club ("Club") event(s) and have not been advised otherwise by a qualified health professional. I acknowledge that my statements on this AWRL are being accepted and relied upon by the Club; the Club's officers and directors; and Club and event sponsors, organizers and administrators;  in permitting me to participate in any Club event.  In consideration for allowing me to become a Club member in a USA Triathlon Chartered Club and allowing me to participate in Club events I hereby take the following action for myself, my executors, administrators, heirs, next of kin, successors and assigns: a) I AGREE to abide by the Competitive Rules adopted by USA Triathlon, including the Medical Control Rules, as they may be amended from time to time, and I acknowledge that my Club membership may be revoked or suspended for violation of the Competitive Rules; b) I WAIVE, RELEASE, AND DISCHARGE from any and all claims, losses or liabilities for death, personal injury, property damage, theft or damages of any kind, which arise out of or relate to my participation in, or my traveling to and from any Club event, THE FOLLOWING PERSONS OR ENTITIES: USA Triathlon; Cleveland Triathlon Club; Club and event sponsors, producers, and volunteers; all states, cities, counties or localities in which Club events are held; and the officers, directors, employees, representatives and agents of any of the above; even if such claims, omissions or liabilities are caused by the negligent acts or omissions of the above persons or entities; c) I ASSUME THE RISK of participating in any event associated with the Cleveland Triathlon Club including but not limited to, falls, contact and/or effects with other participants, any hazard posed by other participants, spectators or volunteers, defective equipment, or weather conditions.  All such riks being known and appreciated by me and I acknowledge that these risks may be the result of the negligence of persons or entities mentioned herein; d) I AGREE NOT TO SUE any of the persons or entities mentioned above for any of the claims, losses or liabilities that I have waived, released or discharged herein, even when caused by actions, inactions or negligence of the persons or entities named above; and e) I INDEMNIFY AND HOLD HARMLESS the persons or entities mentioned above from any claims made or liabilities assessed against them as a result of my actions, inactions or negligence or of those persons or entities mentioned above in connection with any Club event.
